A stay of execution granted in the High Court late yesterday leaves the United Progressive Party in control of the government, at least for now, despite Justice Louise Blenman’s earlier ruling that three of the parliamentary seats controlled by the United Progressive Party (UPP) are invalid.
Justice David Harris was asked to hear the respondents’ application for the stay of the ruling after Justice Blenman left the court, and the country, without inviting the parties involved in the case to address the court.
Justice Harris said the attorneys for the petitioners are to attend a hearing on April 16 to indicate whether they would challenge the stay of execution which puts a hold on the ruling at least until the matter is heard in the Court of Appeal.
The lawyers for the UPP candidates expect to file an appeal by Tuesday.
His decision came about three hours after the initial ruling, which caused many, including learned attorneys, to opine that the country was on the verge of a constitutional crisis.
The stay came as Attorney General Justin Simon was addressing the media in the corridor of the High Court, outlining what Justice Blenman’s ruling meant insofar as governance of the country was concerned.
“The order this afternoon means that the UPP government is still in control of the country. That Dr Winston Baldwin Spencer is still the prime minister; that Dr Jacqui Quinn-Leandro is still a member of Parliament and the Minister of Education; that the Hon John Maginley is still the minister of tourism and still the parliamentary representative for the constituency of St John’s Rural North, So in very simple language, nothing has changed from yesterday,” one of the attorneys representing the UPP members of parliament Leon Chaku Symister said as he emerged from the inner chamber to take over from Simon.
But even the staunchest UPP supporter might be forced to admit that Symister’s rhetoric was an attempt at bravado rather than fact. Whatever the final result of the appeal process, in the while, the ALP has scored both a tangible and moral victory.
Several elected members of the UPP, as well as general members, after recovering from the shock of the judge’s ruling, openly lamented the divide between the party and its supporters as they left the High Court. “This has taught us a hard lesson about neglecting our people,” one MP said.
Last night, Chairman of the Antigua Labour Party Gaston Browne said the stay of execution granted by Justice Harris did little, if anything, to put a damper on his party’s expectations of being returned to power.
In fact, he said the legal counsels for the ALP were considering if Justice Harris erred. “What I have been advised is that, perhaps, he was misdirected in that he is not an election judge and doesn’t have the locus (standi) to grant such a thing, and we have also been advised that our attorneys were available to deal with the stay ex-parte, … The issues are now before our learned counsels, and they will advise us on the way forward,” Browne told The Daily OBSERVER.
Earlier in the day, immediately after Justice Blenman’s ruling, Browne told this newspaper that any appeals on the part of the UPP would only frustrate the people.
He issued the unlikely plea for the UPP to call either by-elections or general elections forthwith.
“In the interest of the country, the UPP should demit office now. Clearly, this is the first part of the victory and we are going to take it home to make sure that there is a change in the governance of the country in order to ensure peace and prosperity,” Browne said.
After the stay of execution was granted, Prime Minister Spencer said, “As of now the United Progressive Party administration is still in power. The status quo remains the same, and I am the Prime Minister of Antigua & Barbuda,” in response to an OBSERVER reporter’s question, “What do you have to say to the country?”
The petitioners in the matter were ALP representative Arthur Nibbs, who challenged Barbuda People’s Movement candidate Trevor Walker’s win without success; St Clair Simon, who filed on behalf of ALP candidate in St John’s Rural West Gail Christian against Baldwin Spencer of the UPP; the ALP’s candidate for St George, Dean Jonas, whose case was against the UPP’s Dr Jacqui Quinn-Leandro; and Charles “Max” Fernandez, who challenged John Maginley, the candidate for the UPP in St John’s Rural North.
Maginley expressed “disappointment” while Dr Quinn-Leandro declined to comment. Walker told The Daily OBSERVER he was pleased with the ruling in Barbuda but was nonetheless disappointed with the decision in the other three petitions.
Fernandez, meanwhile, said, “We felt right after the morning of elections, having listened to people and looked at the facts, we were confident that we would have been victorious. The best celebration that I can have is to redouble my efforts in the constituency and commit to the people and show them that although this seems like a victory, we don’t have time to celebrate. The celebration will come when we turn the country around.”
The defeat left the UPP’s members and supporters shell shocked inside the courtroom with their countenance showing disappointment and disbelief, while the members and supporters of the ALP immediately went into celebration mode in and around the court compound and then via a march through the streets of St John’s which ended at the Antigua Trades and Labour Union (AT&LU) head office at 46 North Street.
UPP supporters who remained inside the courtroom turned to their leaders and parliamentary representatives asking, “What does this mean?”
Symister, the immediate past chairman of the UPP gave an answer about two hours after the Justice Blenman’s ruling, saying, “The stay has been granted … We are going to appeal. This decision has to be overturned.” (By Mickel Brann and Martina Johnson)

It seems to me that the PM and his advisors need to be concerned less about the legal maneuverings, and focus more on the politics affecting this decision yesterday. As a lawyer practicing abroad, I know it is typically the right of the litigants to a civil trial to appeal the decision of a lower court. However, this is not any typical civil trial. When it takes more than a year after a disputed election for a court to hand down judgment in favor of the plaintiffs (the ALP), I think it is incumbent upon the PM (or whomever has the legal authority to do so) to immediately call a fresh election to decisively settle the issue. To go through an appeals process in a matter like this that could potentially take years, is no way to govern a country. It is simply bad politics.

If the UPP (the government for now) has nothing to fear then they would just accept decision made by the learned Judge Blenman. It would rather be fitting to hold bi-elections, or fresh general elections, and let the people speak. In my opinion getting a ‘stay’ indicates some FEAR! Look at what Manning is doing in Trinidad. A few accusations, and what he has decided to silence the voices in opposition, is have elections and let the people decide. After all the final decision should be made by the people! My concern is that the voice of the people needs to be heard. It is ridiculous to prolong this ‘election issue’. It is going to be a very expensive venture, to appeal. WHEY WE GO GET DE MONEY FRAM? As a result, let’s go back to the polls and let Antiguans decide, who they wish to elect. It is all about moral integrity and honorable behaviour! Why must we keep the country in any limbo? Resolve the matter already. The stay and any idea for appeal of the judgment, in my opinion are ridiculous.

thoes who do not learn from history always repeat the same mistakes. all the ALP did was to dust off the old play book from the 70.s they use on PLM with a few alterations and use it on the UPP. added to that in the 70′s there was an oil crisis and world wide recessin. fast forward to 04 there is once again a world wide recession; history realy have a strange way of repeating itself. I can’t recall oil being ove 100 dollars per barel during the ALP tenure yet the economy was on the verge of collaps before the advent of a world wide recession

I did say in my comments last week that we would be up for a rude awakening. All the speculations are now over. I said that because of the length of time taken by Judge Blenman to arrive at her decision which means she did her due diligence on the matter. Even the release of the decision to have been scheduled one week after it had been reached should tell us that it would not have gone in the existing government’s favour. I hope that integrity and objectivity will prevail.

I happened to be at the High Court yesterday, and all of the lawyers for the ALP were outside of the courthouse giving interviews. How could Judge David Harris grant an ex-parte stay of execution? Chaku claims that they could not get in touch with the ALP lawyers. That is a brazen lie. If Chaku had the nerves to face the celebrating public, all he had to do was walk outside. The lawyers were right outside.
Anyway, jump high, jump low, they will not escape their day of reckoning.

This is as a result of being social irrational and to me the ALP is very much in the drivers seat so we can hide behind all the laws and other persons to seek protection but at the end of it all we will have to vote. For the love of country and self I would advise the UPP government to do what is right and save face by calling an election now. This is not only about them as individuals because we have allowed them to govern as they have dicarded die-hard supporters like myself and it would to almost impossible for them to to attempt to mobilize me for sure to advocate on their behalf. The leadership of the UPP has plauged with indecisive policies and so now they are paying the price for such. If the UPP is pro Antiguan then they will call an election ASAP as they will certainly undermine and already fragile economy that will plunge further once we live in a state of limbo. If you are a real man and not a whimp like your former party chairman then show that you are not afraid and return to the poles and not let a court determine your political future. Sorry but you ahve allowed the old master to return and now that is haunting you to say the least. This might be a blessing in disguise for the country as it may cause us to avoid the IMF and other bad decision makings along the way…If I judge from the track record of Chaku and the Attorney General and i was a betting man history certainly would not cause me to put my money on the UPP in winning any legal challenge. Chaku call the election now and remember that the UPP is an advocate of justice and now we see how it works…. Careful of what you wish for because it can come back and haunt you…. remember you guys love the courts and seems like Antigua is a practice field for you guys to learn the law but you are making a big mess of it..

The Judges ruling is a victory for the people of Antigua and Barbuda. The UPP has no love for people: Are ALP supporters the only ones who cannot afford to cash their groceries in the supermarkets without leaving behind the half in the basket that they can’t afford? Are ALP supporters the only ones who constantly receive overpriced utility bills? Are ALP supporters the only ones who are suffering? UPP needs to call the elections, be they BI or general. This needs resolution. Going through the process of appeals with all the loop holes they will seek to invoke to drag this out until the general elections are constitutionally due.

@ Cool Ruler: For 5 of the 6 years that the UPP has been in power, they have collected more than twice the amount of revenues the ALP collected in their best year. Yet, we have not got a thing to show for all taxes they extracted from us. Not a single thing! …well, except poverty and hard times. I was deeply dissapointed in Observer Radio yesterday. There was no immediate coverage of the judge’s verdict. Instead folk music was being played. This would have never happened in the days of the ‘Bush Commissioner’. Listeners were forced to turn to other radio stations in frustration. There wasn’t even a evening panel discussion on the verdict!Please Observer radio, return to your roots and report breaking news immediately and have more panel discussions.

The Representation of the Peoples Act clearly state that that Elections should be held BETWEEN the hours of 6 AM and 6 PM.
The court ruled yesterday that any late start voids the election that is: any start after 6 AM – how stupid can this ruling be? Do we recognize what this means – if the voting starts one second after 6 am that is it. No elections in Antigua will ever be valid again!!!!!!

I agree with the earlier comment. All the government needs to do is ship out all them foreigners and send them back to where they come from. The government try their best to help them and yet all they do is lambaste the administration on ZDK hate radio every night. Send them back to their country cause if it was us in Jamaica or Guyana, we wouldn’t have that kind of say. The Government stays in place for now. However, the PM and his supporters, I am sure, didn’t sleep well last night. They are still in shock and disbelief! Why should they? The UPP has committed the very wrongs, it accuses the ALP of! The UPP have now given the ALP all the momentum they need for a re-run election for those three seats. Well, like my mother always say: take your defeat, and live to fight another day. If I was the PM, I wouldn’t appeal this decision. I would just call re-run of the elections for the three seats in question in the Justice ruling. Let the people decide the faith of our country, and stop delay the process (it will just complicate matters). My friend, VeNoM, you’re still in hiding! It is such a shame that my Antiguans are in such a denial at such a curcial time in our contries history. When the PLM took office back then my mother was employed by the ALP at which time she was called by the then Commissioner of Police Wright George that she should not return to work because Bird did not win the election at which time my mother had two of my older siblings in private and had to find a job as fast as she could so that my brother and sister could have continued to get a private education, at at that time when they took office I was a young child in Antigua but I was well aware as to what was going on in our country, there was a dark and heavy cloud hanging over our country and once again that cloud has return in the form of Baldwin Spencer and his crones. I always know my fellow countrymen are not great at remembering what have happen to them in the pass but I think that the majority of Antiguans know what prosperity is and if anyone both here in America and back home in Antigua say to me that our country is at its best then we do not know what prosperity means. I was in Antigua in 2008 and I was in shock and still is today how my people survive and how they are even able to support themselves and their families when the cost of living is so high.
Antiguans are paying higher taxes on food stuff than we do in America and please people in America we do not pay tax on food or medicine so it really ticked me off that I had to pay taxes on food stuff that I do not pay in America. As a country we are so accepting of the nonsense that are been fed to us by our leaders that we sit back and act like we are un-educated. Baldwin Spencer wants to turn Antigua into a Cuba. I will close by saying we elect you and what you do ultimately affects all of us and from what am seeing the only people that are benefiting are the ministers of the UPP.

I wonder if this Guyanes Judge would have ruled the same way in the case of Lester, Asot, Tco and Molwyn if the UPP had challenged them; becasue their polling also started late and I agree with Eric she has set a precedent in that no election can start at 6:01a.m. This woman is ridiculous; and then to not want to hear the appeal clearly she has a bee in her bonnet. Many right thinking Antiguans know this Guyanese judge has no love for the UPP and Baldwin and is a close friend of the Fullers. once again foreigners have decided our elections. Hi cool rider, Boy you seem to be a staunch UPP supporter. But take this into consideration during UPP’s first term they blame the ALP for everything. During this current term they are blaming the world crisis. Does that mean that UPP has done nothing wrong? What evils ALP has done in 28 years the UPP has surpassed it in 6.
